These Terms govern your use of the Appintellect service, Desktop Agent, dashboard, and APIs (collectively, the "Service") operated by {{LegalEntity}} ("Appintellect", "we", "us"). By using the Service you agree to these Terms. If you're using the Service on behalf of an organization, you represent that you have authority to bind that organization.
If you have a separate written agreement with us (a pilot agreement, MSA, or order form), that agreement controls where it conflicts with these Terms.
1. The Service
Appintellect is an autonomous mobile QA tool. Given a mobile application binary you provide, our Desktop Agent explores the application, builds a map of its screens and transitions, and surfaces anomalies (crashes, logs, visual differences) through a hosted dashboard.
What you provide: debug builds of mobile applications you have the right to test, optional login credentials for those applications, and an AI provider key (currently Google Gemini).
What we provide: the Desktop Agent software (downloadable client), the hosted backend that stores your screens / runs / anomalies, and the dashboard.
2. Accounts and keys
We issue your organization one or more API keys. You are responsible for keeping them confidential. Any action taken with your key is attributed to your organization. Notify us within 24 hours of a suspected key compromise; we can rotate at any time.
During the pilot phase there is no per-user login. One key per organization; we rotate on request or on employee departure. We will ship per-user authentication before general availability.
3. Acceptable use
You agree to use the Service only to test applications you own, you are authorized to test on behalf of the owner, or are publicly available debug builds intended for this kind of exploration. See acceptable-use.md for specifics. We may suspend accounts that violate these rules.
You must not use the Service to:
- Test applications without the owner's permission
- Scrape, stress-test, or otherwise abuse third-party services via applications driven by our agent
- Process personal data of end users beyond what is strictly necessary to exercise the application under test
4. Your AI provider account and costs
You bring your own Google Gemini API key. You pay Google for any AI usage the Service incurs on your behalf. The Service enforces a per-tenant daily spend cap you set in the dashboard to prevent runaway costs. You set the cap; we enforce it. If you set the cap too high and the Service bills you more than you expected, that is not our liability.
5. Pricing
During the pilot phase the Service is {{pilot_pricing_terms}}. We will give you at least 30 days written notice before transitioning to paid pricing.
6. Data
See the privacy policy for full detail on what
we collect and how long we keep it. In summary: screens, logs, and
anomalies from your crawls are stored in our hosted backend for up to
{{default_retention_days}} days unless you delete earlier (via DELETE /projects/{id} on the API or the dashboard's delete button). You
can export your data on request.
7. Confidentiality
We treat the contents of your crawls — screens, logs, internal app text — as your confidential information. We do not use it to train models, we do not share it with third parties except our listed sub-processors, and we apply the same care we would to our own unreleased product data.
8. Intellectual property
You retain all rights to your applications, test data, and crawl outputs. You grant us a limited license to process that data solely to provide the Service. We retain all rights to the Appintellect software, dashboard, and documentation.
9. Warranty disclaimer
THE SERVICE IS PROVIDED "AS IS". We do not warrant that the Service is bug-free, uninterrupted, or will catch every regression. Appintellect is a QA tool, not a guarantee. You are responsible for independent verification before shipping.
10. Limitation of liability
To the maximum extent permitted by law, Appintellect's total liability arising from the Service shall not exceed the fees you paid us in the 12 months preceding the claim, or {{default_liability_cap_usd}} during the pilot phase where no fees are paid. We are not liable for indirect, incidental, or consequential damages.
11. Termination
Either party may terminate at any time with 30 days written notice. On termination we delete your data within 30 days of the effective termination date unless you request earlier deletion or a data export.
12. Changes to these Terms
We will notify you via email at least 30 days before any material change takes effect. Continued use after the effective date constitutes acceptance.
13. Governing law
These Terms are governed by the laws of {{jurisdiction}}. Disputes go to {{dispute_resolution_venue}}.
